Content Is Protected by Intellectual Property Laws
The material and other content on this website is the property of individual member institutions of the Digital Library of South Dakota (DLSD), is protected under the copyright law of the United States (Title 17, U.S. Code http://www.copyright.gov/title17), and may have other restrictions as well. Copyrights and other property rights in the material and content on the website may also be owned by individuals and entities other than, and in addition to, the DLSD member institutions. The DLSD expressly prohibits the copying of any protected material and content on this website, except for the purpose of fair use as defined in the copyright law, and as described below. The member institutions of DLSD are eager to hear from any copyright owners who are not properly identified so that appropriate information may be provided in the future.
Fair Use Is Permitted
Fair use of copyrighted material and content includes the use of protected material and content for non-commercial educational purposes, such as teaching, scholarship, research, criticism, commentary, news reporting, and other content. Unless otherwise noted, researchers who wish to download or print text files, image files, audio clips, and video clips from this website for such uses may do so without the express permission of DLSD member institutions, provided that the material and content will only be used for personal, educational or noncommercial purposes; the researcher must cite the author and source of the material and content as they would material from any printed work; the citation must include all copyright information and other information associated with the material and content and URL; and researchers must comply with all other terms or restrictions which may be applicable. The DLSD and its member institutions are not legally liable for copyright, privacy, or publicity infringement when material and content is wrongfully used after being provided to researchers for fair use.
It is the researcher’s obligation to determine and satisfy copyright or other use restrictions when publishing or otherwise distributing material and content found on this website. All permissions to reproduce material and content in books, articles, exhibits, videos, or other formats must be obtained by the researcher from the rights holder, which is not necessarily the DLSD or the individual institutions that comprise the DLSD. The researcher agrees to hold the DLSD and its member institutions harmless from legal claims arising from the researcher’s use of such material and content. Permission for such use is granted on a case-by-case basis at the discretion of the faculty or staff of the institution holding the material. In granting permission to publish materials and content held in DLSD, the DLSD member institutions do not surrender their own rights to thereafter publish material or grant others permission to publish it.
All use of material and content of the Digital Library of South Dakota, whether utilized under fair use or used with written permission to publish, must name the owning institution/repository as the original source for the material. The name of the owning institution/repository can be found in the Submitting Institution field of the descriptive information accompanying each item.
